What Happens If You Ignore Calls From a Collection Agency?

I am living under a thousand dollars a month. I have no money to pay my debts after all the bills are paid. The money is left from paying the bills is for groceries for a month. I am on fix income of Social Security. At the start I answer the calls from the debt collector. I could not accept their payment offer because the money is not there to continue payment. Then I read and saw on video s to not answer the debt collectors calls. According to the Social Security law the loan collector can not touch Social Security income to seniors or disable on SSi . The only thing they can do is freeze my bank account or take me to court to sue me. Can you live on $975 a month on Social Security? . I am lucky I can rent an apartment after selling my home. I sold my home to pay off the equity loan. I am struggling to make ends meet every month on $ 975. a month. No money to purchase things in cash or make credit card payment

1. How do I take a company to small claims court after it has gone to a collection agency?

Yes, you absolutely can take them to court--and win, too, if you can show that their information is UNsupported. It would cost the collection agency far more money to defend this type of action than to just settle, but even if they are hard asses, take them to court anyway. The damages, however, would have to based on any financial loss you have experienced due to their failure to instruct the credit reporting agencies to remove their derogatory information. Contrary to popular misinformation, you can also sue T-Mobile as well as the credit reporting agencies for the same reasons. Just look up what happened to Trans Union time and again. But it will initially cost you time and money.

safe be buggered Tell the no good thief to pay up

3. I am making a $200 payment to credit card collection agency today, Should I get anything in writing for it?

First change your checking account. If this debt is past the SOL, you do not have to pay it. If you do want to pay it, offer them 30% on the dollar. Let them counter offer and then get it in writing. Send them money orders once you get the new terms in writing

4. I have 4900$ Debt And It's Past Due Cz I Lost My Job,They Called Me And Threatened Me To Go Collection Agency?

"Those people take advantage of us when we lose jobs. They do not feel it's tough times we going through!" quote Now let's not blame them because you ran up a debt. We can all lose our jobs at any time. This is why many of us pay cash only or do not purchase. Use your savings or that bill will be sent to a Collection Agency. We do not have debtor's jail in Canada and you can not get blood from a stone , so all they can do is take your car for the debt. This may take 8 months to happen. CASH.

5. I have never heard from a Collection Agency regarding a Debt on my Credit Report...Can I still have them...?

Yes, write to Marymount. In the meantime, request a copy of your credit report from one of the three major agencies. If the Marymount debt is listed on your credit report, send a copy of your Marymount letter to each of the agencies so they will have your denial of responsibility included in your credit report. Note that you are entitled to a free annual report from each of the three agencies. Since they basically all have the same information, by requesting a free report every four months, alternating between agencies, you can easily stay on top of your credit status at no expense to you. This can all be done online.

6. Collection agency keeps calling my home number for my son?

The next time they call, talk to them. Get the name of their company and what state they are in and who the person is who's calling (may be a number or first name with last initial). Ask them to explain what exactly they are collecting and who they represent. Tell them to send proof of the debt and give them an address. They have within 30 days of your demand for proof to send you something in writing verifying the debt. In this initial letter, they must also give you a little disclaimer about their being a debt collector and anything you tell them can be used to collect the debt and so on... If they refuse to send you something in writing, tell them to stop calling and you will be reporting them to the Federal Trade Commission (www.ftc.gov.) The Fair Debt Collection and Practices Act is a federal law that regulates debt collectors. If they violate this law in attempting to collect a debt, you can sue the company and get money damages ($1,000 per violation by the statute). The FTC website has some good information on what is allowed.

Can a Collection Agency Acess Your Safe Deposit Box
No, only the bank may access your safe deposit box, and then only after you allow the lease on the box to expire. Once the payment for the box expires, the bank must wait a certain amount of time (this is laid out in the deposit contract and in some state laws) and attempt to contact you to either collect your belongings from the box or renew your contract. After this period elapses, you are considered to have abandoned the box to the bank and the contents become the bank's property. However, if you leave items such as a deed or a title, you still legally own that property - the bank has a piece of paper that says you own that property. Is this a Credit Reporting Agency or a Collection Agency? I received a call from Equifax with an 800 number?NCO is like the other answers have said a collection agency. They likely have some kind of account you did not take care of. Though that's a guess on my behalf. I do not know where you filled out your form for a free credit report, but if you go to www. annualcreditreport. com you can get a copy for free and see what if anything is being reported on you by NCO. They may have been telling you that if you do not pay them they will report you to Equifax. It may be some old debt that is more than 7 years old. If this is the case, do not bother to send them any money. Debt that is more than 7years old can not go on your credit report. They may try to coax you with a payment plan or some small "good faith" payment. Do not do this either, it will start the statute of limitations over and then this will allow them to report it again, so be cognizant of this. Equifax does not allow others much less NCO to use their name. As far as your final question goes, this is just how they verify your identity when you get your free report. If you did not open, or refinance a mortgage in 2004 just say you never had one, or none of the companies,Can a Collection agency Come after a minor For unpaid rent?my peer is 100% wrong. THE only time a minor may sign a contract is when he/she is emancipated; no other exceptions. IF a minor does sign one and it is accepted by anyone, the contract can become valid when the minor reaches age 18.Do I have to work with a collection agency for a student loan debt that is unpaid since 1994?You do not have to "work with" the collection agency. You do have to pay the debt, unless there is a law that says otherwiseIs it possible for a collection agency to suspend my driver license? No. Only the DMV can do that, typically in response to a moving violation, accident or court order. Debt collectors do not have that sort of authorityWhat should I do when a collection agency tries to take my house from me for a $3000 debt? Is that legal? If a collection agency seizes your property because of an unpaid debt, it must sell it in a commerciall reasonable manner -- not give it away to a relative. I do not believe the collection agency can seize and sell your mother's house for a credit card debt. They can try to force her into filing bankruptcy, but they can not just say, "Your house is mine." The collection agency does not "own" the house because of a deliquent credit card debt. The credit card company and its agency do NOT own your mother's home because she is past due on her credit card debt. I live in Florida, and the only way I can lose my jouse to a creditor is if I am past due on my mortgage. I do not know what the law is in New York, but your mother needs an attorney. Your mother needs a good bankruptcy lawyer, and she should save all correspondence from the collection agency and anyone else concerning the house. Unless your mother gave the credit card issuer a mortgage on her house to collateraize her credit card debt, the issuer has no claim on the house that is ahead of all her other creditors. It soulds like the credit card issuer is trying to intimidate her. Get a bankruptcy attorney!
